The American Legislative Exchange Council (ALEC) is a group of global corporations and state politicians that vote behind closed doors to try to rewrite state laws that govern your rights. These so-called “model bills” reach into almost every area of American life and often directly benefit huge corporations. Through ALEC, corporations have “a voice and a vote” on specific changes to the law that are then proposed in your state, including Nevada.

I once thought that we, meaning us ordinary voters, elect people to serve in the states’ senates and assemblies to represent us voters in the writing and passage of laws that govern us. Turns out that isn’t exactly the way it is.

I’ve often wondered if our elected state senators and assemblymen/women personally sit down and draft the bills they intend to offer for debate and to be voted upon by both houses of the state’s legislature. I’ve also wondered whether those bills are actually read by our voting legislators and understood before they are voted upon.

May well be some of those bills are neither written nor read before being voted upon.

Members of ALEC may well have written the bills then handed them over to an elected legislator to present to the state’s senate and assembly for passage and transmission to the governor to sign into law.

On July 13, 2011, the Center for Media and Democracy unveiled this trove of over 800 “model” bills and resolutions secretly voted on by corporations and politicians through ALEC. These bills reveal the corporate collaboration reshaping our democracy, state by state.

The Center for Media and Democracy writes “ALEC has long been a secretive collaboration between Big Business and ‘conservative’ politicians. Behind closed doors, they ghostwrite ‘model’ bills to be introduced in state capitols across the country. This agenda—underwritten by global corporations—include includes major tax loopholes for big industries and the super rich, proposals to offshore U.S. jobs and gut minimum wage, and effort to weaken public health, safety, and environmental protections. Although many of these bills have become law, until now, their origin has been largely unknown. With ALEC Exposed, the Center for Media and Democracy hopes more Americans will study the bills to understand the depth and breadth of how big corporations are changing the legal rules and undermining democracy across the nation.”

A whistleblower provided a copy of the 800 model bills to the Center. The Center has analyzed the “bills” and resolutions in an effort to help the reader understand the bills, identify the legislation in their state and the wide extent of the agenda to rewrite our rights by the corporations that bankroll ALEC.

“These bills and resolutions reach into almost every area of American life: worker and consumer rights, education, the rights of Americans injured or killed by corporations, taxes, health care, immigration, and the quality of the air we breathe and the water we drink. Only by seeing the depth and breadth and language of the bills can one fully understand the power and sweep of corporate influence behind the scenes on bills affecting the rights and future of every American in every single state,” the Center says.

The Center seeks to “expose ALEC, its corporations and politicians, and how money has corrupted the democratic process….ALEC boasts that it has over 1,000 of these bills introduced by legislative members every year, with one in every five of them enacted into law.”

The Center asserts that 98% of the funding of ALEC comes from corporations, corporate trade groups, and corporate foundations. Each corporate member pays an annual fee of $7,000—25,000 dollars. “ALEC also receives direct grants from corporations, such as $1.4 million from ExxonMobil from 1998-2009….It has also received grants from some of the biggest foundations funded by corporate CEOs in the country, such as: the Koch family Charles G. Koch Foundation, the Koch-managed Claude R. Lambe Foundation, the Scaife family Allegheny Foundation, the Coors family Castle Rock Foundation, to name a few.”

ALEC has one Democrat out of 104 legislators in leadership positions. “ALEC members, speakers, alumni, and award winners are a ‘who’s who’ of the extreme right. ALEC has given awards to: Ronald Reagan, Margaret Thatcher, George H.W. Bush, Charles and David Koch, Richard de Vos, Tommy Thompson, Gov. John Kasich, Gov. Rick Perry, Congressman Mark Foley (intern sex scandal), and Congressman Billy Tauzin. ALEC alumni include: Speaker of the House John Boehner, House Majority Leader Eric Cantor, Congresswoman Michelle Bachman, Congressman Joe Wilson, (who called President Obama a “liar” during the State of the Union address), former House Speaker Dennis Hastert, former House Speaker Tom DeLay, Andrew Card, Donald Rumsfeld (1985 Chair of ALEC’s Business Policy Board), Governor Scott Walker, Governor Jan Brewer, and more. Featured speakers have included: Milton Friedman, Newt Gingrich, Dick Cheney, Dan Quayle, George Allen, Jessie Helms, Pete Coors, Governor Mitch Daniels and more,” according to the Center.

That Republican Representative Paul Ryan’s budget plan will change Medicare “as we know it,” seems to be widely accepted. Democrats oppose the Ryan Plan across the board. Many in Mr. Ryan’s own party reject the Ryan Plan. The plan would transform Medicare into a voucher-style system dubbed “premium support.” You’d get federal dollars to supplement the purchase of health insurance in a regulated private market.

Republican Senator Scott Brown of Massachusetts has stated he will not vote for the plan. Brown states it would force seniors to pick up too much of the burden for rising healthcare costs. He fears that as health inflation rises, the cost of private plans will outgrow the government premium support forcing the elderly to pay ever higher deductibles and co-pays. Brown also noted that “Medicare has already taken significant cuts to help pay for Obama’s health care plan.” President Obama and Congress cut a half trillion dollars to the private side of Medicare leaving seniors at risk of losing their Medicare Advantage coverage.

Brown states, “We should start by making improvements to the traditional Medicare plan.” The Government Accountability Office estimates nearly 10 percent ($47 billion) of annual Medicare spends is nothing but waste, fraud or abuse. Attorney General Eric Holder puts the figure at $60 billion. Medicare administrators need to prevent those improper payments instead of paying then chasing to recover the improper payments proposes Brown.

Brown also thinks savings could be increased by increasing congressional oversight of how Medicare reimburses providers and improve the quality of Medicare to seniors. He also suggests tort reform to limit frivolous lawsuits.

Republican Senator Susan Collins of Maine has said she will vote against the Ryan Plan, which seeks to cut $5.8 trillion in federal spending over 10 years.

The Ryan budget proposal passed the House on April 15 235-193. The public is divided on the issue. A USA Today/Gallup Poll last month found 44 percent supporting Obama’s budget compared to 43 percent backing Ryan’s. Still, 66 percent said they were worried the Republican plan would cut Medicare too much, while 71 percent said they were afraid Democrats wouldn’t go far enough in addressing the deficit.

Nevada Republican Senator Dean Heller voted for the Ryan Plan when he was in the House and said he’d vote for it again as Senator. Republican Joe Heck voted for the Ryan Plan in the House.

Both Heller and Heck were chastised by the Nevada Democratic Party for misleading Nevada seniors by claiming the Ryan Plan would not affect seniors over age 55 issuing the following statement:

“The GOP budget plan would reopen the donut hole and result in over 26,000 Nevada seniors paying $15 million more alone in prescription drug costs next year. This clearly affects Nevadans over the age of 55 and Heller and Heck are wrong to mislead them. Their reckless pandering to the TEA Party would nearly double prescription drug costs for seniors and end Medicare as we know it, all so they can cut taxes for millionaires.”

Republican Newt Gingrich, criticized the plan as "radical" and "right-wing social engineering” but has backed away from his criticism receiving a skewering by conservatives.

The GOP is squirming between a rock and a hard place. Having described the Medicare Reform as socialist Obamacare they are discovering that their voter base isn’t all that enthusiastic about repealing Obama’s Medicare Reform, whether socialized or not. They are also discovering that extreme positions can be dangerous to their political health.

In any event even though the House has passed the Ryan Plan the GOP will have a difficult time in getting the Plan approved in the Senate. And even if they do President Obama will veto it. That leaves the GOP with the problem of getting a 2/3rd’s vote to override his veto. Not likely.

A legal question has arisen whether the Town of Pahrump could even convey use of the leased land to Growponics. The property upon which Growponics wishes to build was conveyed to the Town of Pahrump some years ago, but with a deed restriction requiring that the property could only be used for a public purpose.

The question being whether or not Growponics use of the land would be for a “public” vs. commercial use of the land. The Town’s attorney says the lease/option agreement is valid and does not run afoul of the deed restriction. The Nye County District Attorney’s opinion is the exact opposite. So there is that legal conflict.

The question has been bantered about for several months now, without being resolved. Frankly, I don’t see why either the Town or Nye County or both don’t simply file a Petition for a Declaratory Judgment with the District Court seeking a judicial determination as to the effect of the deed restriction.

Now, it seems, rumors are filtering about that Growponics actually wants to grow marijuana, rather than leafy vegetables. Residents of Pahrump seem to hatch rumors at the drop of a hat.

Then it turns up there is another problem. A Pahrump resident named Jack Sanders, says he has an agreement with Nye County which would be breached if an agricultural business is permitted on the leased property. Mr. Sanders is apparently intending to develop a winery close by the Growponics site, and that he understood from his agreement with Nye County that a public park would be placed on the property.

So it sounds like the Town and the County have obligated themselves to opposite purposes. Sort of the left hand didn’t know what the right hand has been doing with respect to the leased property.

Nothing new about the lack of communication and coordination between the two local governments. They seem to be reluctant to work together, but that is a whole different book. But it does indicate to me a significant reason why Pahrump shouldn’t incorporate so they can operate as a town and conduct their business more rapidly than they seem to be able to do under their current jurisdictions.

So the Growponics matter gets on the agenda, then gets tabled, and delayed seemingly over and over and over.

It is no wonder it is so difficult to attract businesses into Pahrump and Nye County, and the jobs they create. Having to fiddle around in dealing with two separate governmental entities to get anything done would discourage any business owner from locating here. If it were me I’d be tempted to just throw my hands up and shake the Pahrump/Nye County dust from my feet and see about relocating in Utah, California or Arizona and get on with it.

I invite you to check out the internet links to the Growponics business given above and check it out for yourselves. To me it is a no brainer. Having Growponics here in Pahrump would be a good thing—a very good thing—not only for Pahrump and Nye County but for Growponics as well. They intend to grow all those leafy vegetables here to become a supplier to all those restaurants and grocery stores in Las Vegas and Pahrump, plus Farmers’ Markets with fresh produce which doesn’t have to be shipped in from Mexico or wherever else, lessening the costs. Plus with an expected $5 million dollar budget shortfall Nye County faces after the state of Nevada finishes their budget, Nye County and the Town of Pahrump needs the tax revenue Growponics will provide.

At their last meeting, November 29, 2010, the Central Committee expressed some interest in initiating a website, blog, newsletter, etc., in an effort to establish a communication link with all 9,000+ registered Democrats in Nye County.

The Nye County Democratic Central Committee has a history of being an inert anonymous group that holds boring monthly meetings in Pahrump with an audience of a handful of attendees.

A significant reason for that sad history is because of a simple lack of using available tools to communicate with Democrats in Nye County. They have been urged to use communication techniques such as (1) a website, (2) blog, (3) e-mail newsletters, (4) Twitter, and (5) Facebook to inform Nye County Democrats of just what the Nye County Democratic Party is doing, if anything, to increase the Democratic population of Nye County.

The election of 2008 demonstrated that there are thousands of Democrats in Nye County that are interested in the political landscape of the county and are willing to actively participate for causes they believe in.

So, I have a suggestion for each of you Nye County Democrats. E-mail the chairwoman of the Central Committee and inform her you want to hear from the Central Committee regularly about the plans the Central Committee has in preparation for the 2012 election. That you want access to (1) a website, (2) blog, (3) e-mail newsletters, (4) Twitter, and (5) Facebook so that you know what is going on within the Democratic Party.

You can email the chair, Bonnie Swadling, at nyedemchair@yahoo.com, and urge her and the Central Committee to get with it and start keeping you posted.

You can begin with e-mails, and you might be interested in checking out their new blog I set up for them yesterday at http://nyecountydems.blogspot.com/.

Send her an email, and leave her a comment on their new blog and tell them what you think and want them to do.

Thank you for your effort. Things get done from the ground up, rather than from the top down.

Jack Wood

Watching Gene Cranick’s home burn

There are, at least, two different visions of governance in America. One is conservative and the other is progressive, or liberal, pick your label.

Take the recent experience of the Gene Cranick family of Obion County, Tennessee. Obion County is, like Nye County, a rural governmental division. It is located in northwest, Tennessee. The Obion County seat is Union City. The population of Obion County in 2000 was 32,450.

The Cranick mobile home is located outside the small town of South Fulton, Tennessee, which sits along the state line boundary with Fulton, Kentucky. Homeowners living outside the town limits of South Fulton, in order to secure fire department services from South Fulton must pay an annual $75 fee.

Last week a trash fire got out of hand and ignited Cranick’s double wide, which is located outside the city limits. The fire department was called but while the fire truck was en route, it was discovered that the Cranicks had not paid the $75 fee required for home owners outside the small town.

The Cranicks, who had always paid the $75 fee in the past, said they forgot but when they asked for help, the fire chief, David Wilds, refused. The Cranicks pleaded that their pets were still inside, but that made no difference. Instead, a couple of firefighters watered the lawn of a house nearby to guard against sparks because the neighbors had paid the annual $75 fee.

“South Fulton officials defend the decision, saying if they had fought the fire then nobody would pay the $75 “pay to spray” fee anymore,” reported Roy Exum in The Chattanooga.com.

“There were no human fatalities in the fire, but those several dogs and cats perished and, of course, the Cranicks lost everything they had. Later in the day the Cranicks’ son, Timothy, went to the fire hall and clobbered Chief Wilds in the nose. He was promptly arrested for assault and later released,” wrote Exum.

So what does the Cranick story have to do with “two different visions of governance in America”–conservative and progressive? Glenn Beck will explain:

Glenn Beck, (watch the video) “agrees with the decision that the city made to let the house burn down.”

“Beck then went on to say that the Cranicks would be ‘sponging off their neighbors’ if the fire department had helped them put out their fire. The radio host concluded his rant by saying ‘this is the kind of stuff that’s going to have to happen, we are going to have to have these kinds of things.’”

For me Beck summarizes the difference. From the conservative view everybody is on his own. If you don’t pay don’t look to government for anything. Doesn’t matter if you can pay and don’t or don’t pay because you cannot—when your house catches fire put it out yourself. Government is your enemy. It wants you spend your money for fire alarms and such. Be in an auto accident and need an ambulance to transport you to a hospital? Don’t call unless you have the ability to pay for police response, the ambulance and hospital bill, assuming you’re conscious and could call. Wounded while serving in Afghanistan or Iraq, or Vietnam or Korea? Unless you can afford to pay for privatized medical care–tough luck. No Veteran’s Administration available. Though “we thank you for your service.”

Brings the Golden Rule to my mind. "Therefore all things whatsoever ye would that men should do to you, do ye even so to them." (Matthew 7:12, see also Luke 6:31)

Photo: Mark Zukerberg, from Wikipedia.

Facebook was born in February 2004. It now has 500 million active users. Facebook was founded by Mark Zuckerberg, a 20-year old Harvard Sophomore, with his college roomates and fellow computer science students. Zukerberg’s idea was to form a network so that students could get to know each other better. It was initially limited to Harvard students. Zuckerberg was born May 14, 1984 in White Plains, New York. He is now 26 years old and is CEO of Facebook, Inc.

In January 2009 Facebook was ranked as the most widely used social network worldwide in monthly active users.

Facebook generated 450 visitors in its first four hours online. Within its first month more than half the undergraduate population at Harvard was registered on the site. It expanded to Stanford, Columbia and Yale. It gradually expanded to all Ivy League schools, New York University and the Massachusetts Institute of Technology. Expansion continued to universities in Canada and the United States. It currently gains 1 million new users per day, according to David Kirkpatrick, author of “The Facebook Effect.” It is located in Palo Alto, California. Facebook is currently open to all persons age 13 or older with an e-mail address.

The website is now worth some $15 billion dollars. More people visited Facebook than Google in 2010. A movie about Facebook, called “The Social Network” will be released next month.

Facebook is a social network where friends communicate with each other and keep track with what their friends are doing. Kirkpatrick states users of Facebook will reach 1 billion users worldwide within another year. He says that communications between people via Facebook exceeds that of e-mails.

Pahrump, Nye County and residents of the entire state of Nevada are well represented on Facebook. Not only individuals, but politicians and multiple businesses are active on the site. Groups of all kinds maintain active use of Facebook. For example “Positive Pahrump” has 1,781 friends, mostly residents of Pahrump or people actively involved with the Town, reflects positive attributes of the community.

Another group, “Mule-Lick Nevada,” is a humorous parody about Pahrump that is one of my favorites.

Local politicians use Facebook. Both Tony DeMeo and Scott Cobel, candidates for election to Sheriff of Nye County, have a presence on Facebook. You can learn a lot about each just by visiting their Facebook pages.

Whether you love or dislike Sharron Angle you will find her there as well.

Both Laurayne Murray and Dan Schinhofen, competing for election to the Nye County Board of Commissioners pursue their campaigns on Facebook. So do Carolene Endersby, Tom Waters and Don Rust, running for Town Board of Pahrump. Brian Kunzi, candidate for Nye County District Attorney, is there, though I did not find Ron Kent, his opponent.

Oddly, neither the Nye County Democratic Party nor Republican Party maintain a presence on Facebook that I could find. The Nye County Republican Central Committee has a website but seems to ignore Facebook. The Nye County Democratic Central Committee not only ignores Facebook but the internet completely since they have no website presence at all.

One would think both political parties would be communicating furiously with their members by both methods, particularly with the November elections fast approaching.

Facebook’s effect on the American political system became clear in January 2008. Both Facebook and Twitter has virtually revolutionized politics. Facebook is an extremely popular and powerful new way to interact and voice opinions on the political scene.

Facebook has been blocked intermittently in several repressive countries including Pakistan, Syria, People’s Republic of China, Vietnam, and Iran.

The impact of Facebook on the future of the United States has been recognized. Particularly with the younger generation, which is quite familiar with the Internet, Facebook, Twitter, instant messaging, and the whole range of communicative techniques of modern 21st Century. For the first time in history ordinary people are capable of personally interacting with each other, governments notwithstanding. That is a good thing.

Today, President Obama signed legislation to provide urgent fiscal relief to school districts across the country to maintain our education system, and to enable 160,000 teachers to keep their jobs.

The 160,000 figure is nationwide. Nevada’s share is 1,400 teachers.

I assume that a portion of those 1,400 teachers will be here in Nye County.

The question is: “Will those Nye County residents that are concerned about Obama’s ‘big government spending’ rise up in protest, demanding the federal money be rejected?”

By the way, Senator John Ensign voted No (to reject the money) and Senator Harry Reid voted Y (to take the money). [Congress.Org]

This is segment I of a video of Carolene Endersby, a candidate for the Town Board of Pahrump, Nevada.

Carolene was interviewed for about 20 minutes about where she came from, how she came to Pahrump, why she is running for election, what she hopes to accomplish if elected.

There will be a series of of incremental clips of that entire 20 minute interview uploaded to YouTube and posted on this blog. The reason for the increments is to chop the 20 minutes into small bites making it possible to upload the files for your viewing. YouTube won’t permit uploading an entire 20 minute video—thus it must be done in increments.

In addition to this blog the video’s will appear on Twitter and that way transmitted to some 211 followers of tweets I publish. Additionally the video series will appear on Mrs. Endersby’s campaign website. Also, the videos will be displayed on Friends of Carolene Endersby for Pahrump Town Board on Facebook. Of course you can always see her videos on YouTube.

The plan is to upload each segment in about two-minute segments because of the size of videos and because it permits a viewer to download the videos to watch much faster than it would take it the entire 20 minutes of video would have to be downloaded.

You are welcome and invited to contact Mrs. Endersby about her campaign, her plans and aspirations concerning the Town of Pahrump. You can contact her on her campaign website or Facebook or via her email at ecarolene@gmail.com or phone her at 775-513-0709. Additionally, her calendar schedule is contained on her campaign website so that you will know when and where she will be appearing throughout Pahrump during her campaign. That way you can meet with her personally.

Lots of people in Pahrump have particular concerns about their town and community over a wide range of matters. Mrs. Endersby is aware of that and wishes to meet as many of you as possible to discuss the matters which concern you most. So take advantage of the opportunities to talk with her. You will find she is an excellent listener, very intelligent, very committed to improving our community here in Pahrump. I can assure you that you will be glad you took the time and exerted the effort to meet her.
